Terms and Conditions

We stand by the quality of our work and want you to be completely satisfied. If you are unhappy with the delivered media, refunds may be granted strictly under the following conditions:

• No Usage: You must not have published, distributed, or used any of the provided media in any capacity. This includes uploading photos to MLS, social media, or print, as well as utilizing any numbers, dimensions, or data from the provided floorplans.
• Paid in Full: The invoice for the services rendered must be paid in full.
• Timeframe: You must submit a formal request for resolution/refund within seven (7) days of the files being delivered to you.

Resolution Process:

If the above conditions are met, we will follow this step-by-step resolution process:

1. Editing & Retouching: We will first attempt to resolve the issue by providing additional editing and retouching to the existing files to meet your requirements.
2. Reshoot: If the edited files are still not satisfactory, we will schedule a complimentary reshoot of the property.
3. Refund: If the results of the reshoot remain unsatisfactory, we will issue a full refund for the service.

Matterport 3D tours require active server hosting to remain accessible online. Our policies regarding Matterport hosting are as follows:

• Complimentary Hosting: All Matterport 3D tours include three (3) months of complimentary hosting, beginning on the date the link is delivered.
• Ongoing Hosting: After the initial 3-month period expires, it is the Client's responsibility to contact YVR Listing if they wish to keep the tour active. Ongoing hosting is available at a rate of $17.50 per month.
• Archiving: If we do not receive a request to continue hosting upon expiration, the 3D model will be archived for a grace period of two (2) months.
• Reactivation: During the 2-month archive period, the model can be reactivated. Reactivation requires a $25.00 fee plus a minimum of one month of hosting, totaling $40.00 to bring the tour back online.
• Permanent Deletion: After the 2-month grace period has passed, the model will be permanently deleted from our servers.
• Recovery Exceptions: In special circumstances, we might be able to recover a deleted model. Please reach out to us directly to inquire, though recovery after deletion is not guaranteed.

The Client acknowledges that they do not acquire ownership of any media at any point, regardless of payment status. YVR Listing retains full copyright and all intellectual property rights over every piece of media it creates.

YVR Listing's Right to Reuse, Resell, and Repurpose:

YVR Listing expressly reserves the unrestricted right to reuse, repurpose, redistribute, sublicense, resell, or otherwise exploit any and all media produced, in any form, for any purpose, without limitation. This includes, but is not limited to:

• Using images, videos, or other media in YVR Listing's portfolio, website, social media, advertising, and marketing materials.
• Reselling or licensing media to third parties, including other real estate agents, brokerages, builders, stagers, developers, or any other individual or organization.
• Incorporating media into other projects, publications, or commercial works at YVR Listing's sole discretion.
• Using media for training, demonstrations, exhibitions, or educational purposes.

By engaging YVR Listing's services, the Client consents to the above and waives any claim of exclusivity over the produced media.

Client License:

Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use the media solely for the purpose of marketing the photographed property. This license covers MLS listings, social media, and personal real estate marketing materials associated directly with the sale or lease of that specific property. The license expires when the property is sold, leased, or taken off the market. Media may not be sold, transferred, or given to third parties (including builders, stagers, or other agents) without prior written permission from YVR Listing.
